Bellco Construction Ltd General Information Terms and Condition
The “Contractor” is Bellco Construction Limited” and the “Client” is a person or entity seeking goods and/or services from the contractors.
A quotation is a formal offer made by the contractor to the client, all quotations given are only valid with the company letterhead and the headed title ‘Quotation’ no other document given should be recognised as a ‘Quotation’. Our quotations are produced with as much detail as possible to avoid any misunderstandings. If something is missing that you would like to be included, please let us know and we will revise the quotation accordingly. Any additional works found necessary are to be agreed with the client and a separate revised quotation or variation to the contract is to be provided. All variations will be itemised within our invoices separately. Variations carried out without a fixed or estimated cost will be charged at our standard rates and margins.
A ‘estimate’ is a formal offer made by the contractor to the client. An estimate is a estimation of costs. Not a definitive quotation and may be subject to variation or change.
Please note where the term provisional cost is used (P.C.), this means a cost or item of work which at this stage is either an unknown quantity or an optional piece of work. All provisional items are completed /or not, only after consultation with the client before work commences.
Accepting (written or verbally) a written quotation, estimate or estimation from Bellco Construction and agreeing to the commencement of work will allow these terms and conditions to come into effect and deem that the works have started. The Client or contractor may withdraw from the quotation offer prior to the commencement of works without sanction or penalty however any deposits paid by the client will be used to pay for any materials or products ordered on the client’s behalf. All materials or products will be forwarded to the client with delivery charges. Bellco Construction also reserved the right to recover any preparatory costs incurred prior to physical commencement on site should the Client give notice of cancellation.
The main contractor, Bellco Construction may employ both direct and sub-contracted labour to work on-site. Each individual contractor takes full responsibility of their own third party liability insurance. The main contractor will oversee all works to completion and takes full responsibility in the running of any contract agreed with the client.
An indication of the lead-in time to commence work may be given. Please note that this can change as all works are programmed in order on a “as formal instructions are received basis”
An indication of the time to complete the project may be given. Once instructed we will use our best endeavours to complete the works, from an agreed commencement date and in a programmed manner designed to meet the target completion date. There are however a number of common circumstances which may delay the intended completion date, which are beyond our reasonable control, and for which we will not be held responsible. Examples are: Inappropriate weather conditions, unforeseen ground conditions, existing building faults, changes in specification or time lost in considering possible changes, the involvement of pre-tender nominated sub-contractors, utility companies and any person or organization who is able to act unilaterally during the course of the work. If the contract duration takes longer than expected no extra charges will be levied unless previously agreed. If good progress is made and the contract takes less time to completed than estimated, the client should not expect to receive a discount.
All prices quoted are calculated on the basis of free access and unimpeded working during our normal working hours. Our standard working hours are between 8.00am – 6.00pm Monday to Friday and Saturday 8am – 1pm. Unless otherwise agreed.
Access & Facilities:
Reasonable access to the work areas will be required during working hours and by prior agreement holding areas for the storage of bulk materials, plant and equipment. Generally, a cost free 240v electricity supply for use with power equipment and tools associated with the works is to be provided by the client unless otherwise agreed. Generally, we will require a mains pressure water supply to be used in association with works and staff welfare.
Free access is required for delivery of building materials, plant, machinery and skips etc
Access and the collection of used or unused building materials, equipment and plant remains in place until full and cleared final payment is received.
Performance of Materials & Products
Most materials & products whether man made or natural (such as wood) are subject to naturally varying environmental conditions and may expand contract warp or twist temporarily or permanently as a result. Additionally, some materials will naturally resist ingress of moisture or readily accept moisture under certain environmental conditions. Whilst we will always be happy to provide our opinion as to whether a material or product will be suitable for installation in a particular environment, we make no guarantee of the performance of such materials or products. We strongly advise that Clients refer to the manufacturers recommendations.
Payment can be made via bank transfer, by cheque or cash. Please note all cheque payment incur a £25 administration fee. Cheques are to made payable to ‘Bellco Construction Limited’ All payment information can be found at the bottom of your invoice. Payment terms, interim payments and deposits are all set out in either the contract or order confirmation document. Unless specific terms are set out within the quotation, terms of payment are strictly on receipt of invoice. Bellco Construction reserves the right to charge interest on any late payment of 8% plus the current bank of England base rate.
Main Contractor discount and retention:
Main contractor discount and retention will not apply in any case unless expressly agreed in writing by Bellco Construction Ltd prior to commencement of the contract.
We hold £5,000,000 Public liability and £10,000,000 employer’s liability cover at all times and this can be inspected upon request.
Clients are reminded it is a common requirement of policies issued by Domestic Building Insurers to be advised when building works are undertaken on the property.
All customers will benefit from a full guarantee on our workmanship for a period of 12 months after practical completion of works. The guarantee only covers new work and does not apply to any repair work carried out. Repairs to building, roof, infrastructure or any existing work is not covered by our guarantee. Guarantees on materials and products run in accordance with the manufactures warranty periods where applicable. Our guarantee covers all new work and new materials used in construction but does not guarantee the integrity of any existing structures, materials or decorations. Subsidence issues are not covered within our guarantee period. In event of failure after the guarantee period we will be happy to investigate the cause and negotiate a solution to the problem without delay (if it is found our company is wholly responsible for the failure) and carry out any agreed repairs as soon as possible. Charges may apply for remedial work carried out beyond guarantee dates or to items not covered by the guarantee. Decorations are signed off on completion and not covered by the guarantee.
All new build properties are covered by a building warranty further details to be discuss with the client.
Options for 5 year and 10 year guarantee period.
No responsibility can be taken by the contractor for the presence of perished, infested or rotten timbers (or any other materials) in existing structures such as doors, constructional or other timbers, windows and frames whether detect or undetected at the time of contract.
Whilst we endeavour to protect all existing surfaces (floors, carpets and soft furnishings) with dust sheets and plastic sheeting etc along with care in our working practices, responsibility for protection from damage of any existing surface or fabric etc is responsibility of the client. Arrangement can be made to put into place protection of existing surfaces, over and above our basic cover, at a negotiated additional cost.
Builders waste is deemed to be waste generated by the contractor whilst carrying out building works and includes materials taken down or demolished by the contractor. The material can be used by the client or contractor for hardcore or masonry infill. All on site or road side skip contents remains the property of Bellco Construction until collection by the skip company.
We will endeavour to employ a helpful attitude at all times and will always attempt to bring the building works to a satisfactory conclusion as soon as possible taking into account weather conditions and the availability of specialist materials and any unforeseen circumstances.
